The terms on which Marple is provided. A customer also signs a service agreement, and where the two differ that agreement is the one that governs.
These terms are between Letzbytes and the organisation that subscribes to Marple. Whoever accepts them confirms they may do so for that organisation. A signed service agreement, where one exists, takes precedence over anything on this page.
Access to Marple as a hosted service, for as long as the subscription runs, with the capabilities described on this site at the time of subscribing. The product changes: we add capabilities, and occasionally we retire one. We will not remove something a customer depends on without telling them first and leaving time to adapt.
A customer is responsible for who they invite, what those people do in the workspace, and keeping credentials safe. Roles and permissions exist so that access can be narrowed, and two-factor authentication is available on every account. Tell us promptly if you believe an account has been reached by someone who should not have it.
Everything a customer puts into their workspace remains theirs. We do not sell it, do not use it to train models, and do not share it between customers. We process it to run the service and on the customer's instructions. A customer can export their data while the subscription is live, and we delete the workspace when it ends. Marple may not be used to break the law, to process personal data without a lawful basis for doing so, or to discriminate against candidates on a protected ground. It may not be used to send unsolicited bulk messages, to attack or overload the service, or to resell access to someone who has not agreed to these terms. Where recruitment law imposes a duty on an employer or an agency, using software does not move that duty to us.
The extension works inside the recruiter's own browser session and at a pace a person works at. Using it is subject to the terms of whatever site it is used on, and honouring those terms is the recruiter's responsibility rather than something the software can decide for them. We do not hold anyone's credentials for those sites, and our servers do not contact them.
Marple drafts, summarises, scores and suggests. Everything it produces is a draft for a person to check, and it can be wrong. A recruiter reads it before it reaches a candidate, a client or a decision, and the responsibility for what is sent or decided rests with whoever accepted it. We do not warrant that generated text is accurate, and nothing generated is a substitute for a hiring decision made by a person.
Subscriptions are charged per recruiter, monthly or annually, at the prices published on the pricing page or agreed in a service agreement. Fees are payable in advance and exclude VAT. Where payment fails we will say so and allow time to fix it before access is affected.
We aim to keep Marple available and we tell customers about planned maintenance. We do not promise uninterrupted service on a standard subscription; where a customer needs a committed service level, that belongs in a service agreement. Support is by email, and the response we aim for depends on the plan.
Neither party excludes liability for anything the law does not permit to be excluded, including death, personal injury and fraud. Beyond that, neither party is liable for indirect or consequential loss, or for lost profit or lost opportunity, and our total liability in any twelve month period is limited to the fees paid in that period.
A customer may cancel at any time, with access continuing to the end of the period already paid for. We may suspend or end access where these terms are seriously or repeatedly broken, or where fees go unpaid after we have asked. After the agreement ends, the workspace is deleted.
These terms are governed by the law of Luxembourg, and the courts of Luxembourg have jurisdiction over any dispute arising from them.
